€70,000 Settlement for Cleaner Who Was Injured at Work

Physiotherapist examining a woman's back and shoulder after a back injury at work

Shane Walsh and the litigation team at Anthony Joyce and Company recently successfully obtained compensation for a client who suffered significant injuries to her back when she tripped over a hazard during the course of her employment.

What happened

In summary, our client worked as a cleaner. She was asked to retrieve fresh towels, as she returned to the storeroom where they were kept she tripped over a bed cover which had been left on the floor. Our client caught herself, however she strained her back in the process causing her significant pain. She was not able to continue in the course of her employment and loss of earnings formed part of her personal injuries claim.

Injuries Resolution Board and High Court proceedings

The matter was submitted to the Injuries Resolution Board, and the matter was released as our client’s employer declined to have the Injuries Board assess the claim. High Court proceedings were issued and a full Defence was issued by our client’s employer.

How Discovery proved liability

On foot of this Anthony Joyce and Company sought Discovery from the Defendant, upon receipt of the Discovery Documentation an incident report form revealed another employee had left the bed cover on the floor at the end of the previous day’s shift. Following receipt of the Discovery documents the Defendant ultimately accepted liability and a settlement was reached without our client having to give evidence in court.
