Shane Walsh and the Litigation team at Anthony Joyce & Co Solicitors, recently obtained significant compensation for a client who suffered significant injury, loss and damage as a result of a fall while working in a healthcare facility.
In summary, our client worked in the administration office of a healthcare facility and was caused to slip when water from a water dispenser had caused the floor to become slippery. Anthony Joyce & Co instructed a Consultant Engineer who carried out an inspection of the premises and the water dispenser. The engineer also examined discovery documents obtained from the Defendant in preparing his report. Witness statements were obtained from co-workers confirming that water spillage was a common occurrence in the building at the time the client had her fall.
Unfortunately, due to significance of our client’s injuries, she was not able to return to work which resulted in significant loss of earnings. Anthony Joyce & Co instructed a Consultant Actuary to calculate our client’s past loss of earnings and future loss of earnings which formed part of her claim.
The matter was submitted with the Injuries Resolution Board (formerly the Personal Injuries Assessment Board (PIAB)) and the matter was released as the Defendant denied liability for the accident. High Court proceedings were subsequently issued, a trial date was obtained, and a settlement was ultimately reached without our client having to give evidence in Court.
