Court Settlement 3x the Amount of IRB Assessment Achieved for Client Injured in Road Traffic Accident

Shane Walsh and the Litigation team at Anthony Joyce & Co Solicitors, recently obtained compensation for a client who suffered injuries, loss and damage as a result of a Road Traffic Accident.

Our client was driving her car when a car from an adjacent road to her left drove into the back passenger side of her car causing her soft tissue injuries to her neck, back and shoulders. The matter was submitted with the Injuries Resolution Board (IRB) and an assessment was ultimately made in the sum of €4,995.00. Unfortunately, our client’s pain symptoms in her back persisted at the time of the assessment which were exacerbated by the physical nature of her work. In the circumstances, the client rejected the assessment and instructed us to issue court proceedings on her behalf.

Court proceedings were duly issued and an updated medical report from our client’s GP was obtained regarding our client’s ongoing pain symptoms. A Defence was delivered which admitted liability for the accident but denied the extent of our client’s injuries. The Defendant also made the same offer as the IRB assessment which our client again rejected. We were required to set the matter down for hearing before the matter ultimately settled two days before the trial date for the sum of €15,000 plus legal costs.
