Construction worker who suffered significant injuries to his upper limb receives compensation of €145,000

Anthony Joyce & Co Solicitors successfully obtained compensation for a client who suffered significant injuries to his dominant left hand in a workplace accident.

In summary, due to the unsafe system of work and failure of the Defendant to provide a safe place of work and adequate training to our client, our client was caused to suffer significant injuries to his left hand while using a skill saw. The injured hand ultimately required partial amputation of the index finger and middle finger under the care of the client’s treating Consultant.

The matter was submitted with the Injuries Resolution Board (formerly the Personal Injuries Assessment Board (PIAB)) in April 2020. The Respondent declined to have the claim assessed and an Authorisation was duly issued pursuant to section 17 of the PIAB Acts. Court proceedings were subsequently issued in the High Court in July 2021. A Defence was delivered which admitted liability for the incident but denied the extent of our client’s injuries.

Unfortunately, our client’s injuries remained ongoing long after the initial incident. The client attend with an Occupational Therapist for hand therapy to recover some mobility and functionality in his left hand. The client also experienced significant pain symptoms in the affected area and was unable to return to work as a Carpenter as a result of his injuries. Reports from his Consultant Hand Surgeon and Occupational Therapist were required in respect of his injuries. Expert reports were also required from a Vocational Assessor and Actuary in respect of his loss of earnings arising from his inability to return to work due to his injuries.

Documenting the full extent of our client’s injuries and losses took some time before the matter was eventually set down for hearing. The case ultimately settled without the necessity for the client to give evidence before the High Court.
