Serious Burn Injuries Following Workplace Accident
Our client suffered significant burn injuries after slipping on a wet floor while carrying a heavy pot of boiling pasta to a sink. As a result of the fall, boiling water spilled onto his body, causing burns to his right hand, right side, left buttock and back.
Medical evidence confirmed that the burns covered approximately 8% of his total body surface area, resulting in substantial pain, ongoing treatment requirements and long-term physical consequences.
Expert Medical Evidence Required
Given the severity of the injuries, several expert medical reports were obtained to support the workplace injury claim.
Reports from a Consultant Plastic Surgeon detailed the extent of the burns, permanent scarring and the potential need for future medical treatment. A Consultant Psychiatrist also assessed the psychological impact of the accident, including anxiety and trauma associated with returning to work in a similar environment.
The expert evidence highlighted both the physical and psychiatric consequences of the workplace burn injury and their long-term impact on our client’s quality of life.
Establishing Liability for the Workplace Injury
Expert engineering evidence played a crucial role in establishing liability against the restaurant.
A joint inspection of the accident location was carried out by our Engineer and the Defendant’s Engineer to examine the circumstances that led to the incident. Documentation obtained through discovery included:
- The accident report form
- Training records provided to our client
- CCTV footage of the incident
This evidence assisted in demonstrating how the workplace accident occurred and supported our client’s claim for compensation.
High Court Proceedings Issued
Due to the nature and extent of the injuries sustained, the Injuries Resolution Board (formerly PIAB) issued an Authorisation under Section 17 of the PIAB Acts, allowing the matter to proceed through the courts.
High Court proceedings were issued in February 2023 and the case was subsequently set down for trial.

Before the matter proceeded to a full hearing, a settlement of €70,000 was successfully negotiated on behalf of our client.
