What steps should I take if I suspect medical negligence?
  • Gather all relevant medical records related to your treatment.
  • Keep a detailed record of events, including dates, healthcare providers, and any key details about what happened.
  • Speak with an experienced medical negligence solicitor as soon as possible to assess your case and explore your options.

In Ireland, the time limit is generally two years from when you became aware of the harm caused by medical negligence. 

Exceptions may apply, so seek legal advice as soon as possible!

Compensation considers:

  • General Damages: Pain, suffering, and loss of quality of life.
  • Special Damages: Financial losses, such as medical expenses, lost earnings, and out-of-pocket costs.
  • Factors like the severity of injuries and the impact on your life play a significant role.

Adults over 18 who suffer injuries due to negligent medical care can file a medical negligence claim.

For minors, a parent or legal guardian can bring a claim on their behalf.

If a loved one has died due to medical negligence, a fatal injury claim can be made by a “dependent,” such as a spouse, partner, parent, child, or sibling.

To prove medical negligence, you generally need the following evidence:

  1. Medical Records – Detailed records of treatments, procedures, and consultations.
  2. Expert Medical Opinion – A specialist’s assessment confirming that the care provided fell below acceptable standards.
  3. Proof of Harm – Evidence showing the negligence caused your injury or worsened your condition.
  4. Financial Losses – Documentation of expenses like medical bills, lost earnings, and other related costs.
  5. Witness Statements – Accounts from witnesses or family members supporting your claim.
