In summary, our client was carrying boxes of produce during the course of his employment into a retails store when he stepped into a depression at the front entrance of the retail store causing him to fracture his ankle. The client was absent from work for some time following his injury and a claim for loss of earnings formed part of his personal injuries claim.
The matter was submitted with the Injuries Resolution Board and the matter was released as the retail store declined to provide their consent to an assessment. Circuit Court proceedings were subsequently issued and a full Defence was delivered by the retail store. Anthony Joyce & Co Solicitors duly instructed a Consultant Engineer to inspect the hazard before the retail store investigated the matter further and ultimately accepted responsibly for our client’s injuries. A settlement was reached without our client having to give evidence in Court.
