Shane Walsh and the Litigation team at Anthony Joyce & Co Solicitors, recently successfully obtained significant compensation for a client who suffered significant injury, loss and damage as a result of a Road Traffic Accident.
In summary, our client was the driver in her car stationary in traffic when suddenly and without warning, she was hit from the rear by another car. Our client sustained multiple soft tissue injuries, increased anxiety and low mood. Due to the multitude of injuries, the Injuries Resolution Board (formerly the Personal Injuries Assessment Board (PIAB)) issued an Authorisation pursuant to section 17 of the PIAB Acts. Court proceedings were duly issued in the Circuit Court in April 2020. A Defence was delivered which admitted liability for the accident but denied the extent of our client’s injuries.
Unfortunately, as time progressed, our client’s injuries did not improve. Expert reports from our client’s Pain Consultant regarding pain in her neck, shoulders and lower back; our client’s Neurologist regarding altered sensations and pains in her hands; our client’s Consultant Orthopaedic Surgeon in relation to the arthroscopic procedure required on her right knee following a meniscus tear due to the accident; and our client’s Consultant Psychiatrist who diagnosed our client as having suffered from Adjustment Disorder following her accident merited an application to have her case transferred to the jurisdiction of the High Court.
The matter was successfully transferred to the High Court in April 2023 and the matter was subsequently listed for hearing before the High Court in February 2024. However, the matter ultimately settled before the case commenced, without our client having to give evidence in Court.
